Businesses and investors should consider, as part of contract negotiations, the option of submitting commercial disputes arising among the contracting parties to arbitration for resolution. Commercial arbitration is becoming a more frequently-used mechanism for resolving commercial disputes in many jurisdictions. The process allows the disputing parties a degree of control over the proceedings, confidentiality and transparency. Cambodia’s legal framework in the area of commercial arbitration, along with other jurisdictions in the region, has developed substantially in recent years.

Four cases have been put forward for arbitration to the National Commercial Arbitration Centre (NCAC) of Cambodia in the first half of 2018, adding to eleven cases and four disputes successfully resolved since the NCAC was formed.

This breakfast talk will bring you up-to-date with the local and international framework for resolving commercial disputes by arbitration.

  Alex Larkin – VDB Loi, Senior Legal Advisor

Mr. Alex Larkin is a senior adviser with PYT & Associates, a member of the VDB Loi Group in Phnom Penh. He has been advising clients in Southeast Asia for the last eight years in the areas of foreign investment, corporate law, mergers & acquisitions, and commercial dispute resolution. His experience includes advising on arbitration proceedings in Singapore and in the US, and he was a member of the working group responsible for the drafting of the arbitration rules of the NCAC. He holds a Juris Doctor degree from Seattle University School of Law.

  Mr. Monin ROS – Managing Partner of Camlaw Group, President of the NCAC

Mr. Monin Ros holds an LL.M of law in Cambodia, has been practicing since 2002, and is a board member of the Council for the Bar Association of the Kingdom of Cambodia. Mr. Ros is one of the first commercial arbitrators admitted to the NCAC and is currently the President of the NCAC. He advises on all aspects of commercial law, mergers & acquisitions and corporate finance in Cambodia and across multiple jurisdictions.

  Dr. Romesh Weeramantry – Counsel at Clifford Chance, Singapore

Dr. Romesh Weeramantry specialises in arbitrations involving cross-border commercial disputes and investment treaty claims. He is also Visiting Research Consultant at the Centre for International Law, National University of Singapore. His publications include “Treaty Interpretation in Investment Arbitration” (Oxford UP 2012) and “International Commercial Arbitration: An Asia-Pacific Perspective” (Cambridge UP 2011).
