Myanmar Tightens the Control of Food Production

May 13, 2024

People tend to ignore the importance of complying with food laws and often sell food without FDA licenses in Myanmar. Efforts have been made by local authorities to tighten food production requirements, leading to the amendment of the National Food Law and a significant increase in penalties.

Let’s take a closer look at the amendments:

Section Violations Imprisonment Fines (MMK)
Old (2013) New (2024) Old (2013) New (2024)
28 (a) Producing, importing, or selling food that is: unsafe, altered, has excessive additives or chemicals, or is prohibited, spoiled, or substandard 3 years 10 years 3 million 3-30 million
(b) Producing, importing, or selling food with labeling that is inaccurate or missing information 1 year 10,000 5 million
29 Producing food without a license 5 years 10 years 1-5 million 10-50 million
30 Producing controlled food without a license (such as bottled water or edible oil) 3 years 3 years 1-3 million 3-30 million
31 Non-compliance with food quality assurance, labeling, and advertising regulations 3 years 5 years 1-3 million 3-30 million

The law also introduces a new way of handling evidence—instead of confiscation, the court may order destruction instead.
